Ano nga ba yung SPA (Special Power of Attorney) na hinahanap minsan sa mga tao?

Today, we are talking about SPAs or yung tinatawag nating Special Power of Attorney.

Atty Erwin: “Usually papel yan, Attorney Ramon. Bigla ko tuloy naalala nung bata ako tapos papadalhan ako ng note ng nanay ko kunwari half day ako pero may pasok, kunwari may lakad kami or magpapa check sa doktor kailangan mong umalis after lunch, early dismissal pero just for you...

So ang dala ko may maliit akong sulat galing sa nanay ko and then bibigay ko sa teacher and then magically yung mga kaklase ko nandun pa sa classroom ako makakalayo.

Ang magic talaga ng pirma ng nanay ko!”

Same principle applies here kasi ang yung permission slip na binigay sakin ng nanay ko noong bata ako, actually para ring permission slip yung SPA.

Bakit? Legally kasi, sino ang pwedeng mag pull out sakin galing sa eskwela?

Atty. Ramon: “Syempre si mother mo or dad ko di ba, parents mo... Sila yung may authority.

Atty. Erwin: “Pero nandun ba siya or wala? Wala, dinelegate niya sakin yung authority. Sige, ito ipakita mo ‘tong papel na to then papayagan ka as if nandun ako.”

Same thing with SPA is you are giving another person the power na gumalaw as if nandun ka.

Walang pinagkaiba, kunwari may ari ng lupa and then pa abroad ako magko close muna ako or six months, eh mawawala ako for quite a long amount of time...

So sabi ko, bibigyan kita ng SPA para pwede mong ituloy na ibenta yung lupa habang kahit na nagku-cruise ka merong nagbebenta ng lupa para sayo. As if nandito ka.

So pwede kang pumirma okay, para sakin pwede kang kumausap, pwede mag negotiate, pwede kang tumanggap ng pera para sa akin, assuming na yun yung nilagay ko na power sa SPA.

Kasi yung SPA, kailangan specific kung ano yung power na pwedeng gawin nung pagbibigyan mo ng authority.

The 3 Purposes of Special Power of Attorney (SPA):’

1. To introduce you.

Siyempre ako yung agent, ako yung kilala ng may ari ng lupa. Sino ka ba naman don sa transaksyon di ba? So pag pinakita mo yung SPA ang sinasabi nun is: Ito po yung agent, ako yung ahente mo, tinutuloy nya yung kwento.

2. To authorize you

Doon sa SPA nanggagaling yung legal authority mo para gumalaw on someone else’s behalf which is dapat specific kung ano yung mga pwedeng gawin para sayo. Dun makikita sa SPA yan.

Hindi ka rin pwede lumagpas. Kunwari itong lupang ito lang ang pinag uusapan hindi mo pwedeng ibenta yung iba. Kung ano lang yung binigay mo sakin.

3. To document the authority

Atty Erwin: Kasi hindi naman pwedeng “Pare, paalis ako ha. Ikaw na bahala ha.”

Atty. Ramon: “So dapat, kahit na kahit anong pilit na in-authorize ako, kung walang documentation, hindi mo naman kasi pwedeng sabihin sa buyer na oo tinapik nga niya ako eh. Sinabi ako na raw bahala eh or ito recording.”

But for most transactions here in the philippines an SPA should be sufficient.

Saan ba nakukuha ang Special Power of Attorney?

1. Get a lawyer to draft it for you.

Yan ang pinakamadali kasi we do that as part of our jobs and if you want to have it done professionally, especially for big-ticket items na lupa, it would be a good idea to get a lawyer to draft for it.

Kasi may mga horror story na Nag-DIY medyo may mga provision kulang or sobra.

2. Do-it-yourself

How? Attorney Google!

Google ka special power of attorney template, pwede naman. Wala naman po kasing legal requirement na dapat abugado ang gumawa.

However, iba pa rin po kasi yung experience but for most stuff, kunwari mag claim ng passport, pwede na siguro yun. You can make that work.

However, I have a third option.

3. Get a written guide that explains how legal documents work and gives you a template.

Incidentally, meron kaming libro.
